Understanding California Break Laws

If you work in California, you must follow certain break laws to remain consistent with state standards.

Employees working more than 5 hours must take a 30-minute unpaid food break. If they work longer than 10 hours, they are entitled to a second meal break.

California Overtime Rules

California has more detailed overtime policies than Federal rules. Here’s how it works:

 Daily Overtime (Per Day)

Regular Time: First 8 hours of work

Overtime: Next 4 hours (8–12 hours)

Doubletime: Any time over 12 hours in a single day

Weekly Adjustment (40-Hour Rule)

Only the first 40 hours of the week are considered regular time

If your daily regular hours push the weekly total over 40 hours, the extra hours are reclassified as overtime

7th Consecutive Day Rule

If you work 7 days in a row, the 7th day has special treatment:

First 8 hours are overtime (no regular time)

Over 8 hours are doubletime

Federal Overtime Rules

Federal rules are simpler and focus only on weekly totals.
